hi,
I had entered into an agreement of sale with a party A 2 Months back for an amount of 20 lakhs paid 5 lakhs at the time of agreement. he did not full fill the contract. i do not want get into legal problems with him. so i waited for another month. But he did not paid balance payment. In the meantime party B approached me to sell the same property i asked party A to sell the property and pay back his money "HE AGREED ORALLY" i have entered into agreement with party B i have not disclosed him that i have entered into agreement with party A he paid 10 Lakhs and balance in one month and get it register. After signing the agreement the Party A is not accepting the money now he wants to go specific performance for the first agreement.
q1 what should i do
q2.can i return the money of party B and cancel agreement of party B
q3 cancel the agreement of party A.
Q4 My lawyer told me that the party B Can file a cheating case. what should i do in this case.

1. You did great wrong by entering into agreement with B without cancelling agreement with B.
2. You can even now formally cancel the agreement with A of the terms of agreement supports cancellation.
3.Stick with B and cancel A.

Cancel the agreement with A, take help of your lawyer.

if A has failed to pay balance amount as per agreement cancel the agreement and refund advance received
