Police.

If a police beats up anyone in lock up can that person take action against the officer and how???is there any sections against them for police brutality??

I completely agree with Arunagiri. But in practical it is not possible. If you give complaint before HRC, for the time being the police will keep quiet. The Police keeps an eye on the activities of the complainant, and when they get chance they will implicate him in false cases such as waging war against the country, naxalism, terrorism etc. The police will also gives a gift of 3rd degree punishment. Though the complainant may be innocent, but it will be very difficult to him to come out of the problem. Waste of money and waste of time. Keeping in view of the above fear, most of the people are not daring to give complaint before HRC. Somebody should dare and come forward to give complaint.

Law is meaningless if the law enforcers do not abide by its rigours. It is high time that our legal system sums up the sagacity to entertain actions in tort against such violators of law and to award exemplary damages.

I have practical experience, in HRC cases. Minimum 90% of the officers do not disturb the complainants. Because the HRC case will be a black mark in his career.

Practically the police officers will be treated at par with accused in the HRC.

There is no other alternative for the victims, that is why I have suggested to give a complaint to the SHRC.

I too agree with the views of expert Mr. Arunagiri. I have an experience of attending HRC on a similar case apart from another case against the State Government revenue staff of high ranking. Thus, the state human rights commission may be approached for relief and solace.
