Yes, you can approach the Banking Ombudsman for this. Another option is to file case in consumer forum.

before going to Banking Ombudsman, contact concern branch. Generally, bank will return back.

If you have lodged complaint with the Bank already, remind it. You can approach consumer forum or Banking ombudsman. Alternately you can approach Permanent Lok adalat or Permanent Lok Adalat (Public Utility services) if operating in your district as process is fast and cheaper in these.

Banks correct such lapses in the normal course; please follow up with them. There is no need to rush to Banking Ombudsman.

The right course of action is to submit a complaint to the Bank's branch which has issued the ATM card i.e., in the branch where you have account. There is a specific format for that. If you have the delivery slip, enclose it to the complaint. The Bank will look into the matter and settle it within 2 working days if the error occured in its own ATM. If it is other bank ATM, it will take up the matter with the concerned officials who looks after settlements between the bank. Normally, such errors will be rectified within a week's time. If the bank do not take any action, on the basis of copy of complaint (should get the acknowledgement of the bank), one can approach consumer forum for redressal. Banking Ombudsman is only reconciliatory authority and such type of cases, it is of no avail except wasting time.
