ACRs declared non est

(Querist) 10 January 2015 This query is : Resolved 
My two ACRs written in violation of standard procedure have been declared non est by ministry. Hiw the dpc has to consider the period of these acts? Whether acts of equivalent period from previous years to be considered ? No instrs of DOPT exist on the issue.

Your perception that "no instrs of DOPT exist on the issue" is wrong. If you go through the DPC guidelines issued from time to time by the DOPT carefully and can find the instructions very well.

Administrative authorities seldom uses th expression "non est"; It is a legal term used in a judicial decision.

You have some "misconceived" notion, check it again.
How an employee earn two ACRs during the same period?
Standered procedure is not law but the manner (procedure)adopted by a department for implimentaion of law/orders/directions issued by DOPT.
