Dear Sir,
As per a advertisement, there was 4 vacant seat of Associate Professor in a particular department of NERIST, a deemed university under MHRD, Govt of India. I was fulfilling all the minimum requirement and hence forth got the call letter for interview. Finally result is declared and only 2 got selected. Can I go for court case asking that, if post was available and candidate with all the minimum eligibility was appeared then why not selected?
Please advice me so that i can do something.

Thank you for your reply. I have already asked for following information under RTIe RTI:
1.Total number of Associate Professors selected in GENERAL category in each department.
2.Marks obtained by the selected General category candidates in the interview by the selection committee and weightage given to each candidate for his/her bio data and other heads.
3.Details of marks obtained by Dr. P. K. Pranav (an applicant for Associate Professor) by the selection committee, and weightage given to his bio data and other heads.
4.Minutes of selection committee meeting held during 20-24 Dec 2014 at NIRD Guwahati of all departments for Assistant and Associate Professors.
5.Verified API score of Dr. P. K. Pranav by Scrutiny Committee and minutes of the committee.
7.Department wise available vacancy in different categories for Assistant, Associate and Professors’ level prior to recruitment against advertisement no. 2/2014 as decided by the Deans’ Committee.

You seem to have forgotten to ask for the information on the reason for selection of lesser No. of candidates than the No. of vacancies announced.

If the information regarding lesser no. of selection than the vacancy advertised was not included previously, send another RTI now for the information.

In continuation of my earlier query, I have received the some information through RTI which are as follows:
1. I have got 76 out of 100 by the expert committee and stood 3rd position.
2. Reason for less selection is reservation boundary. Out of 4 only 2 was in general category. However, I would like to mention that department wise reservation was not mentioned in the advertisement. At institute level, there was 10 seats in general category out of which only six selected. Still four seat is vacant in this category.
Please suggest me rules by which i can claim the same.

The sdvertised vacancies of 4 should be filled in accordance with the roster prescribed.The promotion posts will not fall under Direct Recruitment.

Reservation is made only cadre-wise, but not department wise in any particular organisation. You may better go through the reservation policy of the Government of India.

Sorry, can't spare unlimited time in search for the desired judgment, as there are plenty of judgments pertaining to the reservation policies for SC & ST. So, it is not feasible for me to track any such judgment to suit your requirement.
