Letter from embassy of india

Dear Sir,

I am tax consultant.

One of my Clients (proprietor Company) has taken advance payment from German Company (about Rs 1.5 lakhs) for supply of goods. He has failed to supply, German Company has complained to embassy of India in Germany.

Embassy of India have sent email to Company to settle this issue.

I would like to know what kind of action embassy of India can take, (their powers), in such type of complaints. Whether they can send Police to house?

Be honest & gentle in business and suggest your client to refund the advance amount which he is liable to pay and the German Company is entitled to get.

The Indian Embassy can take no action but the the German Company may file case in India ir in Germany also if their law so permits and then the decree may be executed in India or the Warrant may be executed.
So ask your client to make the payment which is due from him.

Indian Embassy in Germany has merely forwarded to ur client the complaint received by them with an advise to settle the matter. It has no legal force nor can it be executed as such. But as advised by the experts if ur client does not return the advance money, the German importer can file proceedings either in Germany or in India to recover the amount with interest and costs.
