Judgement of hon'ble supreme court not being implemented

(Querist) 07 February 2015 This query is : Resolved
Supreme Court of India in Civil Appeal No.9096 of 2013 titled Union of India & Anr. Vs. National Federation of Blind & Ors dated 8.10.13 has provided reservation in promotion for persons with disabilities in all Groups and endorsed it in SLP(C) No.9473 of 2011 in MCD Vs. Manoj Gupta dt. 10.12.2013. Hon’ble Supreme Court of India has also dismissed the SLP arising out of final judgment order dated 4.12.13 in PIL No.106/2010 passed in the High Court of Bombay in Union of India Vs. National Confederation for Development of Disabled dated 12.09.2014. Despite this Department of Personnel is not implementing reservation in promotion for persons with disabilities in all Groups . What action needs to be taken by all employees with disabilities. Kindly suggest how we can get this judgment implemented by the Government? Kindly suggest what should be done? It is a social cause for persons with disabilities.

You seek information, under RTI, from the DoPT of the steps being taken in implementing the directions of the Apex Court. You may also peruse the website of DOPT to verify the orders/instructions, if any, already issued.

A representation claiming promotion by employees should be filed referring the judgement .

Did you again refer the matter to DoPT i.e., subsequent to passing of judgment?? If yes, what is the response from DoPT?
In case, the judgment has not been honoured, implemented in letter and spirit and/or disobeyed by DoPT move a contempt petition.

You have not stated whether some specific direction through any of its judgment was given by the SC to the DOPT or not.

Whether the department has rejected the promotion despite the supreme court dismissal of PIL filed by the government in this regard. this will attract contempt of court, which may be confirmed and proceed with contempt application.
