Mr. Virender Singh,

Suspension, etc. are regulated by the service rules of the organisation. So, it is not a legal issue right now. Moreover, unless you, as a manager maintenance, are vested with administrative powers to suspend your subordinate, you would not be authorised to suspend the worker.

So, if suspension is within your powers, go through the Delegation of Powers, CSO, and HR Manual of your organisation and consult your HR department, if you still have any doubt in your mind about the issue. Otherwise report the matter to the HR department to look in to the matter to be dealt with within the powers of some other competent authority.

you want guidance about suspension.

you have not even informed whether your company is Govt company. If yes whether CDA rules have been seen by you.

If it is private company then what are provisions of standing orders.

Follow the HR rules / service conditions of the organisation.

I agree with experts advise, follow HR/Service rules.
Consult a local lawyer with all information and proceed in a professional manner to avoid legal complicacy at a later stage, which can be devastating.

Well advised by experts, you must follow the rules and procedures meant for this very strictly otherwise it may backfire and you will be shunted out.
