Bonus

(Querist) 04 June 2015 This query is : Resolved 
if as a principal employer i want to give bonus to security guards( both armed and unarmed with salary basic + VDA is 11,024 and 10,010/- respectively ) and mentioned the same in my financial bid, five firms have quoted the same service charge i.e. 2 %, now out of these five firms one has not included bonus as part of pay and is contesting to be declared as L-1, where in other firms have quoted bonus also.
Can this be a ground for being L-1???
Please advise

First of all, the start of the query, "IF as a principal employer i want to give bonus," indicates well that this is your academic query.

Secondly, being a part of tender committee, you can neither be a principal employer, nor a decision making authority on the issue.

Thirdly, yours is not a legal problem, rather it is a problem pertaining to financial rules and procedure for which you need to take financial advice from the internal financial advisor or the CA of your organisation. Moreover, in all tender committes, a member from finance side is also nominated as a member to see the financial complexity of the tenders/ bids. So, he has to see the bid with reference to the financial rules on tenders.

However, if you still feel to get some legal opinion, for legal validity of your action in your organisation, you are supposed to take formal legal opinion from the legal department of your own organisation that too with specific reference to the tender conditions and the contract/ purchase policy of the organisation.

So, from all angles, your query is unfit for legal advice in this forum.
