Complaint withdrawl

(Querist) 11 July 2015 This query is : Resolved
I had filed 2 criminal complaints against my sister for forgery, cheating etc. Now I wish to withdraw both cases as I have been diagnosed with cancer & my health does not permit attending hearings. Will the court allow withdrawal?

PP can make an application for withdrawal of complaint like this one.Don't attend.Your continuous absence will impel court to dis your complaint in default i.e. for want of prosecution

The criminal complaint or f.i.r can be withdrawn only in case the offences under which the same is written are compoundable. in case you lodge an f.i.r u/s 420, the same can be compounded/withdrawn but in case sec. 468,471 are clubbed with it...then you will have to approach the high court for getting the f.i.r/complaint quashed.
