Incomplete housing project/ consumer forum

Dear Sir,
I have booked a flat from employees credit
society for Rs. 1600000/-through registered agreement. dt 07062011. possation period 24 month from dt of allotment. due in mar 2013. I have availed housing loan from bank.amt disbursed Rs. 691000/- upto partial work. Due to internal problems of society , the housing project work get stuck. Inspite repeted reminders society could not restart the work nor refund my money. Shall I move to consumer forum to get refund my money. what time required for result after filling the case. what document required to return the registered agrmt to society.
please guide in the matter.

Move to consumer forum, time depends on work load with the forum.

I agree with experts advise, file consumer complaint.
However, you have another option of filing a suit for specific performance of the contract, where you can recover interest and damages also, along with an injunction restraining the society from creating third party interest.

In spite repeated follow up society now agree to refund amount in instalment due to financial crunch. Till date they have refunded Rs. 2,00,000/- , I have not file the case in consumer forum . If society has refund entire amount , what documents I have to be obtain / given from/to the society. Is there any income tax compliance on my part in future if society sell the entire housing project.
