cheating case

If a cheating case is falsly filed by a person against another person and the matter for which consideration was paid is subjudice can police take action against the person who is the victim( Against whom the complaint was filed)
What action can police take against the victim using the criminal complaint /
the FIR ? How can the victim protect himself from police action?

quation is not clear now what is the matter condition (which consideration was paid is subjudice ) what it mean ???

Consideration was paid after signing an agreement to sell regarding a property share which the victim is entitled to after his father died leaving no will. A will was produced 5 years after his father died by another brother 7 the will was given for probate. Now the builder who took the share is after him to give back the money with exorbitant interest. So he is bent on harassing the victim to get back excess money by hook or by crook.

to escape police harassment obtain anticipatory at the earliest. Your defence is plausible and it would help you.
if there is no breach of contract on your part then you have nothing to worry.the question of returning money and rate of interest will be decided by competent civil court.
if builder takes unlawful measures lodge FIR
