Dear Sir/s ,
I have a commercial shop measuring 100 sq ft in a coop society in Mumbai. The said shop is in myself and my wife s jointly names. Now my wife wants to gift her share of the shop so that it will be fully in my name only. kindly let me know how much stamp duty and registration charges will involve? ( I understand that stamp duty is waived for blood relatives or relatives in Maharashtra)
Moreover as I am a Muslim , does it attract stamp duty or registration ?
And is it legal to process under Muslim Personal Law?
Thanx n Regards ,
Yasin

HI
There is no stamp duty required to be paid.
there is no problem in wife gifting a property to her husband .
However registration fees will be 1% of market value of the property. please contact your sub registrar office for details as sometime ago the cap on registration fees was Rs30000-/-. Not sure whether the cap is still continuing or the cap is now withdrawn

Consult local lawyer and discuss. Registration charges and stamp duty differs state to state.

Under Muslim Law gift deeds (Hiba) need not be registered.
