Where the builder could not handed over flat with in the prescribed time as per agreement then is this matter of consumer forum or breach of contract civil jurisdiction ?

Yes, It comes under deficiency of service because of breach of agreement.

Possession of flat not deliver in time,definitely comes under the purview of unfair trade practice and deficiency in service of builder so you can approach District Consumer Forum for compensation.
