Registry before clearance certificate is valid

Im booking a flat from a builder in 2012 and as per agreement he promise me to hand over my flat within one year and shortout clearance certificate from corporation i paid sum of Rs 1000000/- ten lac with some instalment flat value aprox 1635000/- till date CC not giving from corporation. Now builder aproch me to pay ur dues and register your flat at register office.
Its legally safe for me.pls advice me what to do your opnion is more valuable for me

Dear Bikash,
Not safe before getting completion certificate from the corporation. Othrwise, after registration, the builder would getfree from all of his due responsibilities and liabilities laid down in your agreement.
Better go through carefully the agreement and insist the builder to get all his liabilities cleared first, including getting completion certificate from the local body and the Government, if any.
However, if unable to properly interpret the legal jargons of the agreements, you may get that examined by some capable lawyer to get suitable advice.

Im fileing a case in consumer court for getting my flat with all clearence for registry but in the mean time we got knowledge one of the land lord who given power to builder to build the flat and sold out expired (dead) before sale agreement with me and builder. So my lawyer told me that lodge a F.I.R. in the name of builder for(420) fraud,cheat,and missguide me case is that good for my case.
