Can accused file a petition for sitting during case hearing?

Guest (Querist) 31 December 2009 This query is : Resolved
Is it true that an accused can file a petition seeking permission to sit during his case hearing. Can anyone clarify on this with the correct legal provision?
Devajyoti Barman (Expert) 31 December 2009
The law in criminal jurisprudence itself requires the trial to proceed in presence of the accused person.
If the accused person is physically disabled then he can seek permission from the court to sit during the course of trial.

All the accused are presumed to be innocent. He can sit if he feels so if there is a facility for that. If not he can ask to the presiding officer through his lawyer or in person a facility to sit. Otherwise is such a facility is provided he can sit after the formality is over when he trial starts.

I agree with Suresh.
