Actually my uncle took our property from my grandparents by making fake documents that my grandparents has gifted our house and shop to them..as my grandparents are not literate they signed on their documents.now they are sending us notice to vacant the property before 29 February..my grandfather has lost all his memories as he is 86..but my grandmother is still there and she told the officer in charge how they took the property.now how we can get back the property back on name of my father..is there any solution

how old is the transfer?

without evidence of grandfather how do you prove fraud. if any?

The query lacks clarity. Anyhow, you may move the court against forceful eviction. Police have no authority to interfere in the matter.

Depends upon how you are able to prove that the gift was taken fradulently your uncle.

By the way, have you got a copy of gift deed and contacted the witnesse of the gift deed? If so, what they say?

The fact is that the documents they have arranged lyk that....that the property of ours is gifted to them by our grandparents..and as they are not literate they have signed on the documents..but name is still not registered..den also they r sending us notice to vacant the place..my grandfather has lost all his memories so he cnt go to the court and say all this..but my grandmother is still ok..now how to tk the property back in my father name

By the way, how you are aware of the fact that the gift deed is not registered when you don't seem to have a copy of that?

The experts have raised some points that you have not answered e.g; 'Whether the witnesses are alive'?

What is the opinion of witnesses?

If the gift deed is not registered then probably the revenue officer has declined to effect the change in title/ownership based on unregistered gift deed.

You may engage an able counsel and show the said gift deed and latest mutation record/fard and seek the advise.

The gift deeds were registered in 2009 at udaipur sub register office,udaipur gomati tripura 799120 and applied for mutation from my uncle's part..my grandparents raised an objection against the mutation appeal.accordingly authority (d.c.m.)postponed the mutation till now.the next date fixed for the hearing at s.d.m.'s court on 30 th january 2016.but my query is that if there any provision of law to get back my grandparents property.that,advise of the local lawyer there is no chance to cancel the deed as it was given and sign. By the owner of the property.another lawyer told that the date of suit a case to cancel the said deed were over.according to him case must be registered within 3 yrs from information of knowledge about the deed.The witness are making.the deeds are sign by a commission mentioning that the commission was hold our own residence but it was false.All the matters are making.
