what is the procedure to file the declaration of the civil death, who all has to be made as defendants?

Only the state(government) and the registrar of birth and deaths shall be made the defendants.

Declaratory suit is filed for declaration of death of a person, taking recourse of Sec 107, 108 of evidence Act, whichever is applied to the matter. generally family members, heirs, nearest relatives and State are impleaded as defendant. Some times court requires publication in news paper.
