Property

(Querist) 03 September 2016 This query is : Resolved
My wife's brother forcefully made his widowed mother sign on house property documents and registered the property in his name.Therafter he has been treating her miserably and now wants to evict her from a small room and sell the house.
What are the remedies so that my mother-in-law can live the rest of her life peacefully.
Can my wife threaten him with a suit for partition. Can I file a suit against maltreatment of aged mother?

Record all threats, maltreatment, forced signatures etc etc .

Irrefutable evidence shall always help.

If mother has sold/gifted etc the property by appearing in person then how can your wife file for partition and succeed easily.

Rest your own counsel can guide you further.

Contact some capable lawyer at local level to prepare case against your brother-in-law.

In whose name the property was?

If it was in the name of your father in law and your brother in law has transferred share of your mother in law only, in his name, your wife has share and can claim.

You have also not mentioned, how the share was got transferred, your wife should get a certified copy of the deed from registrar office.

Your MIL can claim maintenance and can take help from senior citizen helpline.
