Interview frods

Sir,

I have cleared an employment exam of Survey of India in the year 2015. But, after interview in final selection list they have added a name where his name was not shortlisted for interview. Subsequently, I went through RTI but in final, I am not getting what action I need to take, as I am week by financially I didn't decided that whether I should file a case or not.
Kindly find attached RTI replies from the department for my queries and suggest me the right path sir please.

You First issue a Legal notice to survey of India and then approach CAT for considering your candidature for the said post in question and you've been subjected to injustice etc.Produce all the RTI replies you've got as evidence in CAT.Certainly you'd be rendered justice.

You stated, "Subsequently, I went through RTI," but you have not mentioned, what information did you get through RTI?

Please be clear in your discussion.

Also, can you clarify, how addition of a person in the short list could affect you in interview?

Application for Information under RTI Act 2005
1. Name of the Applicant: Sacheen P Kattimani.

3. Details of information sought:This is regarding the announcement of result of TTT ‘A’ Recruitment published vide final list dated 27.05.2015.
[a] Sri Raghavendra Rathod [Roll No 3409] has been selected at Serial Number 2 under SC Category in the recruitment result published on 27.05.2015. But, his name was not there in the list of provisionally selected candidates who were interviewed on 12.05.2015. Please intimate under RTI Act, under which provisions of rule he was selected without having been interviewed.
[b] Sri Bharma Gowda SN [Roll No 3034 has been selected at Serial Number 4 under Unreserved category in the recruitment result published on 27.05.2015. But, his name was not there in the list of provisionally selected candidates who were interviewed on 12.05.2015. Please intimate under RTI Act, under which provisions of rule he was selected without having been interviewed.
[c] Kindly furnish under RTI Act, the copy of office order passed by the competent authority for dropping my name [Sacheen P Kattimani [Roll No 3420]] through I was interviewed and my name was included in the Reserved List.
[ d] Under which provisions of rule my name was dropped and in my place Sri Raghavendra Rathod was selected though his name was not in the list of candidates selected for attending interview held on 12.05.2015.
[e] Please furnish information under RTI Act, the details of marks secured by me and by Sri Raghavendra Rathod in various stages of selection process.

The concerned official seems to have explained that SC candidates were give weight-age and numbers are also given.

Respected Sir,

Sub: Complaint against the injustice caused to me in the selection
process for the post of Geo TTT A in Survey of India, Karnataka
Geo Spatial Data Centre, Bangalore during 2015.

I have applied for the above mentioned post and was qualified for Stereo Fusion Test and Interview to be held on 12.05.2015 at serial number 24 of the list [My Roll Number is 3420]. I belong to Scheduled Caste.

Accordingly, I have also successfully completed the interview. But, when the final selection list was published, I was shocked to know that one Sri Raghavendra Rathod whose name was not there in the list of provisionally selected candidates to be interviewed on 12.05.2015 was selected for the post. Then, I submitted one RTI Application dated 02.06.2015. In reply to RTI Query, your office has replied that the name of Sri Raghavendra Rathod was not there in the list of provisionally selected candidates to be interviewed on 12.05.2015 since 5% relaxation in the cut-off for SC/ST candidates was not given at that time and as pointed out by SC/ST Member of Recruitment Board, 5% relaxation in the Cut Off Marks was given to SC/ST candidates and hence additional five candidates were called for the interview on 27.05.2015. Your office has also stated that Sri Raghavendra Rathod is one among the five candidates called for interview on 27.05.2015.

Thus, in the whole case, the following injustices are caused to me.

[a] I also belong to SC Community. Hence, I am also eligible for 5% relaxation in the cut-off. But, I have been kept in dark and I have not been informed whether this relaxation is given to me or not.

[b] As per RTI Reply, Sri Raghavendra Rathod [Roll No. 3409] has secured 127 Marks and I have secured 122 marks in Main Test and Interview. In screening test also he secured 50 Marks where as I secured 35 Marks. Thus, the Marks Secured by Sri Raghavendra Rathod was more. If this is the actual fact, then how his name was left out from the list of candidates to be interviewed on 12.05.2015. This is not clarified by your office.

[c] The rule of giving 5% relaxation to the SC/ST candidates is universal and it should have been known to the Chairman and Members of Recruitment Board. But, as admitted by the CPIO of your office, the rule came in to picture only when it was pointed out by the SC/ST Member of the Recruitment Board. Till then, the whole process was carried out without taking into account this important rule. If this relaxation was initially given, then Sri Raghavendra Rathod would have also attended the interview on 12.05.2015 and question of conducting separate interview for him on 27.05.2015 would not have arose and the injustice would not have been caused to me. But, the Recruitment Board has over looked the rule and caused injustice to me.

[d] If the 5% relaxation was initially given to all SC/ST candidates, then myself and Sri Raghavendra Rathod both would have attended the interview on 12.05.2015 and both of us would have been selected and the name of some other SC candidate who secured lesser marks than us would have been deleted. In the interview I have secured 36 Marks, where as Sri Raghavendra Rathod has secured 30 Marks. It means I was having all chances of being selected being better performer in the interview. But, due to dropping of name of Sri Raghavendra Rathod at the initial stage and due to adding of his name at subsequent stage, the damage has been caused to the candidates who were interviewed on 12.05.2015.

The above narrated facts clearly show that injustice has been caused to me though I came out successful in all the stages of recruitment process. Therefore, by considering the above facts, the final selection list may please be prepared afresh. I hope that justice will be given to me and if the above facts are not considered, I am inclined to approach the judicial forum to seek the justice. By submitting this representation to you, I have deemed to have availed all channels of representation and now I can approach the judicial forum to seek the justice if my this representation is not disposed of by you within reasonable period of time.
