Non Processing of my PF documents from Previous Employer

Dear Sir,

Kindly suggest me that is there is any provision in law to take legal action against my previous employer for non processing of my PF which is due from 6 months since i quit the job. There is absolutely no response to my letters, mails, calls made and personal visits made to that office. Please suggest me what should be done in this matter.

You shall make a complaint before the provident fund commissioner in the district in this regard.

This is an offence on the part of your previous employer and strict action can be initiated at your end as well as on the end of the PF commissioner. You serve a legal notice with a copy to EFP Commissioner of your Region and on failure to get the desired results file a criminal case against your employer under section 406 of IPC.

Your question if interpreted correctly means that you have quit the job, you want refund of PF amount standing at your credit (or transfer to your PF account at the new employer) but the previous employer who is suppose to send a report to the PF Office is not processing your application and sending it.

You may file a complaint with the PF Commissioner. You cannot proceed against your ex-employer for criminal action. If your application is not signed by your employer and forwarded to PF Office, consult a Chartered Accountant who can forward it to PF Office.
