is there any supreme court judgement saying that the right and title of the bonafide purchaser be made valid and protected. please throw light on this aspect with supreme court rulings
Guest (Expert) 04 March 2017
Light should have been expected to be thrown on the exact area of some problem, if that exists, not otherwise.

Better discuss the real problem, if really you have any.

citations not supplied.

the real problem is that i purchased property from my friend who deals in real estate business through registered sale deed, but lately i came to know that the property which i purchased was already transacted with someone else through agreement to sale. Considering the above scenario i am the bonfide purchaser of the property without notice. In order to emphasize my bonafide title i need citation

Citations are not magic wands.
What is the status of the present transaction? Have you been put in possession?
Guest (Expert) 04 March 2017
If "already transacted with someone else through agreement to sale" before you purchased, in that case yours cannot be treated as a bonafide and valid purchase.

Ask your friend to get the case settled in amicable manner. Otherwise, he has done nothing except cheating you by selling an already sold property.

Sri Vijayan.A (Expert) 04 March 2017
It means you are cheated by the seller (Still you want to claim him as your friend?)

Moreover, how do you say that transaction has been completed when only agreement is entered into?

Ask the seller to cancel the agreement and have negotiation for settlement.
Kumar Doab (Expert) 04 March 2017
You have already bought it.

The best recourse is to convince him to refund.

How old is the agreement!
