Sir, I had applied for Probate of Will of my father which was contested and allowed. I was told that within 3 months of judgement I have to pay court fees to obtain Probate certificate. If I pay court fees within 3 months and opponent files for appeal at higher court will my court fees money go waste? Will there be any problem to obtain probate certificate if I pay court fees after 3 months of judgement?
Adv. Yogen Kakade (Expert) 07 March 2017
You have to pay the amount of court fees to obtain the probate certificate.. no other option.

Your are duty bound to pay court fee. Even if an appeal is filed tomorrow even though you shall have to obtain probate certificate else your all efforts will fail.
Hemant Agarwal (Expert) 13 March 2017
1. FIRSTLY probate decree CANNOT be granted without the pre-paid court Fees. ONLY "AFTER" court fees is paid, the Court would issue the probate decree.

2. Appeal CANNOT be filed "TILL" the probate decree is duly granted.

Keep Smiling .... Hemant Agarwal
