Sir. My brother recently taken a car from travell agency, unfortunately he hit a electrical pole.... Now travell agency is harrasing to pay amount of 2 lac for the damage. We requested him to claim for insurance. Neither he is not launching complaint in local police station nor applying for insurance just demanding us 2 lac stating that he is getting loss .. Plz help in this issue how to proceed furthure

Whether the travel agency is running a valid car rental agency ?
If yes what were the terms of rental your brother agreed to ?
Whether the car was authorised to be used as public transport ?
Whether the car was properly insured ?
Whether the insurance policy pays claim even when the car was not driven by owner of the car or his driver?
Whether your brother was having a valid driving licence?
Instead of trying to answer all these question it is better to consult a local counsel with all these details

He has taken on rental and self driven? or He is a professional driver? Own damages may not be covered under insurance and insurance company may interpret negligent driving.. take the help of a local lawyer or request the owner of the car to file insurance claim ..
