Partition Deed

Hello sir
I want to enquire about the partition deed. My father and his elder brother are two legal hiers of the named property in Delhi after relinquishment deed registered in Aug 2016. But now we want to get the partition deed registered ( floor wise ) my father's elder brother is denying to get the partition deed registered without giving any specific reasons. This property has 4 floors including the ground floor.
So pls suggest a way how we can get this deed registered without involving the elder brother, as we have tried to convince him but he is not agreeing to do that. So pls suggest / advice your opinion to get my father's share registered in his name.

Please elaborate your following statements as same are not clear about "legal heirs" and "relinquishment deed":

You may consult a legal expert on property matter with all documents available on title of property for the right advise. If you say both of them are legal heir of property owned by your grand father, both shall have equal share if no other legal heir are there.

Partition deed can not be registered till all parties to it agrees.

Your father can file case of partition to get it done from court.

Apparently other legal heirs have relinquished and now only 2 legal heirs have to partition.


The legal heirs are not in agreement.

After the death of my grandmother the property was to be divided in 4 equal shares (2 sister and 2 brothers). On 29th Aug 2016 we got relinquishment deed registered wherein both sister relinquished there rights from the property. And now both brothers have the right on the property. But now we decided to get the floors partitioned, my father's elder brother is denying to get it done without giving any reason.
Also we have all utility bills and house tax paid for our floors in my father's name.
Pls suggest if there is any way other than court.
