Rejoinder filed and issued framed. Now court directed to come up for evidence of workman for the date fixed. PF/DM and list of witness to be filed within 7 days. Please advice me that do I have to submit list of witness alongwith their proper address and do I have to request court for summoning the witness. Please advice

Yes, as directed by the Court you are required to file list of witness(es) with affidavit of workman along with any other witness.

Within 7 days first I file list of witness and PF/DM. Affidavit can be filed later on.

I intend to file list of witness for summoning and deposit of process fee and dietary money. Affidavit of workman can be filed on the next date. Please advice.

What stopped you from filing list of witness(es) along with an application for summoning (any of them-if official or want to be summoned)with permission to pay diet money on the spot i.e., at the time of deposition and affidavit of workman in one go, why do you intend to delay the affidavit for filing on next date?

As advised by Advocate he replied that first list of witnesses for summoning shall be filed as it is due to be filed within 7 days from the date. Affidavit shall be filed on next date which will take time to prepare and copy of same shall be supplied to opposite party atleast 7 days before the date. Hence I wanted to take the view of experts as going to Labour court is far away place.

You should have faith in your lawyer and proceed as advised. If you have lost your faith in your lawyer change him/her immediately.
