Sir just I discussed this matter with my father who is my senior also. His opinion is-

Sec 37 (a) clearly provides about the application of Cr.P.C.

(b)applies where accused is not arrested by police or magistrate but is arrested by other authorities who may be ITBP, SSB, BSF, or general public also.
