Can a builder handover maintenance of layout without solving legal issues like rajkalava and others?

Yes, the layout is almost complete. It is a layout of individual villas. But with multiple legal issue and out of that rajkalava is biggest one. MC team has taken the handover from the builder, not sure if they are under the influence of builder. Just wanted to know how if builder can handover or MC team can take handover from builder without resolving legal issues.

I am located in Bangalore. Rajkalava is storm water channel, which is occupied by builder and build houses/villas on top of that in my layout. Case is still open in the court. Despite of these legal issues MC has has taken handover from builder for maintenance collection and they have signed a MOU with all legal issues. My question was, is it legally advisable to take handover from builder where multiple legal cases are open in the court.
