Dear All
My husband had singh a bond for a company where he works last 1 and 4 months back it was a bond of 3 years, however reently he was unfit to attend the office and apply for a sick leave for 5 days but reply me bakc that thet dont require any medical report, they wants a person when organization requires and away mentioned that, better to find a govt job, in fact i am also working we do provide sick leave/PL/Cl to all the employees sick leave is unplanned leave we dont know that when we are going to fall sick,... further i dont want him to work in that atmosphere where employees were treated as a slaves of past before independence.... after he gone fit i want him to leave the job what do i do to save those moneys like pf contributions, blank cheques, Medical bonus etc which compnay allready deducted from his salary.. kindly suggest me in a very better way.

You should provide the terms of the bond so that accurate reply may be given, however, if matter is amicably settled then it shall be better for your husband as he has already signed the bond for a specific period.

Usually the employment contracts would contain a provision that if the employee is suffering from medical (mental and physical) problems or declared medically unfit, then the employment may be terminated by both the parties (employee and the company). If there is any such clause in your husband's employment contract then your husband can easily resign the job and claim all the benefits he is eligible for.

Bond is a contract. A contract cannot contain unreasonable or impractical clauses. An employee cannot attend the office if he is bedridden by illhealth. Therefore, the contract cannot come in the way of your husband's sick leave. If they insist that he should have attended the office even when he is sick, their demand has no force and can be challenged.
Make correspondence under acknowledgements to this effect and be protected for future legal problems. An employer cannot deny the legitimate dues of an employee. Legitimate deductions cannot be questioned.
