ancestral property

Querist : Anonymous (Querist) 13 April 2010 This query is : Resolved
I am a 45yr lady, my father has got property through settlement deed from my grand father, can I claim this property as ancestral property
R.R. KRISHNAA (Expert) 13 April 2010
If the property is your grandfather's self acquired property acquired during his life time, then your father gets full right by way of the settlement deed and you cannot claim the property as ancestral property.

But, in case if the said property is not your grandfather's self acquired property then you get a share over it.
adv. rajeev ( rajoo ) (Expert) 13 April 2010
If itz ancestral property of your grand father then you will get the share, otherwise no.
G. ARAVINTHAN (Expert) 13 April 2010
The property is conveyed to your father by way of settlement deed. Your father is the full owner by the same. then it is to be treated as self acquired property only.
you cannot claim his property
Parthasarathi Loganathan (Expert) 14 April 2010
Since it is a clear case of ancestral property, settlement deed has to address the stake or share for the daughter
Raj Kumar Makkad (Expert) 14 April 2010
You are entitled for the share in the property.
