Notice Period

Querist : Anonymous (Querist) 16 May 2010 This query is : Resolved
Dear Sir,

I am serving with a IT company as Manager. Recently i have resigned. For smooth handing taking over i am ready to serve for 30-35 days notice period & pay tbe balance. However my superior is not agreeing to this . He says that i need to serve complete 60 days of notice period. As per appointment letter either party can terminate the contract with 60 days notice period but company reserves the right to recover the amount or nor. Also states that company if so desires thatn than the employee has to work for entire notice period. This is discriminatory, when company can take money in lieu of notice period i should also enk=joy same privelidge and sholud be able to pay for balance notice period. I am in trouble. Experts please revert

Sir, you are bound by contractual terms agreed by you. Though they may be discriminatory but not against the law.

Vineet ,

I do not agree with you.
Notice period rule is equal for both employer and employee. Even if it is not mentioned in the appointment to buy the notice period, it can still be done by employee similar to the rule the employer can relieve the employee at once by offering him salary equal to notice period.

It is general and natural law and no citation is required for this purpose

If you had signed such a contract, you are bound to follow the same as suggested by Mr.Vineet unless the terms/contract is nullified by a court.

If you are so sure that your presumption is "It is general and natural law no citation is required for this purpose" why do you raised this issue here?
