Querist : Anonymous (Querist) 20 September 2010 This query is : Resolved
The petitioner wife has decided to transfer case to Lok Adalat. The case is dissolution of marriage based on crueltiy & desertion which is difficult for her to proove. The maintenance for child is also on the verge of clash as the child is not in school which is mentioned in application. She is having affair.
What is reason going to lik adalat ?
what should I do?
Parthasarathi Loganathan (Expert) 20 September 2010
May be Lok Adalat is cheaper than the Civil Courts in terms of cost of litigation
Devajyoti Barman (Expert) 20 September 2010
The case can not be transferred to lok adalat unless there is an attempt or chance of settlement. In Lok Adalat no contested hearing is made.

Dear Anonymous,

Usually the matter is referred to the Lok Adalat when both the parties are agreeable for the same. It is advisable that you may inspect the records of the case to know for what purpose the matter is posted.

Best Regards

Daksh
