Dear Sir,
I have filed case under section 9 to call my wife at home. Instead coming to home she applied for interim maintanance.
I left one old job and joined another job. when arg. was there between adv. judge ask for the prev. job resignation letter which I cant produce at that time. Court declared next date for ORDER for the interim maint. amount. but I ask judge for give us time the next date We will produce. Judge verbally said ok. After that date come and judge was absent but we Submitted to the court the resignation letter of old job.and then next date given. the next date also judge not come. so question is that will that letter give any effect to the ORDER which is to ber declared by judge next time if he come.

UNLESS AND OTHERWISE THE DOCUMENT IS NOT MARKED BY YOU, CANNOT CLAIM ANY BENEFIT/ CLAIM/ FAVOUR IN THE PETITION. FILE A RE-OPEN AND RECALL PETITION TO MARK THE DOCUMENTS ON YOUR SIDE AND THEN AGITATE.

At the time of hearing of your case or passing the order , the judge will definitely give a look at the resignation letter.

In interim maintenance hearing or order either party can give any document for referral which does not require formal proof or exhibit.

Just wait for next hearing. Just bring it to judge's knowledge that the said document already produced.. He will consider that.. Its will help to judge for fix the interim maintenance amount logically. Thats it.. How ever you have to pay the nominal maintenance till the disposal of the section 9. Petition.

Wait and watch for the next hearing actually taken up by the judge. The purpose of checking the contents of the resignation letter may be best known to the judge only.
