M.Sheik Mohammed Ali (Expert) 30 September 2011
its not come under constitutional rights, they are taking this steps for defence related. so its not possible to claim.
Sailesh Kumar Shah (Expert) 30 September 2011
Dear Mr. Gowtham
I am not aware of these rules, however I am agree with this rules,if applicable.

"100 sms in a day is more than enough." and It is reasonable restriction under Article 19.

you have to put this on 'forum' section of this website to more clarify.

R.Ramachandran (Expert) 30 September 2011
The Restriction on the number of SMSs one can do per day as imposed by TRAI is not correct. It is violation of the fundamental rights of the citizens. I am sure, very quickly TRAI will review its order and make amends.

TRAI is expected to stop only those unsolicited SMSs and calls which are made by Telemarketing Companies.

Raj Kumar Makkad (Expert) 30 September 2011
unwanted Bulk SMS and group SMS definitely violate the fundamental right of a citizen to lead a dignified life and his choice to listen or receive something or everything or not. I strongly stand with TRAI which has given its long awaited care towards general users of these electronic instruments which were targeted by many vested interests to put their ideas without taking into confidence to 'poor' user.

Following vital questions arise:

Who makes 100 or more sms per day, an ordinary xitizen or telemarketing companies?

Whose fundamental rights are violated, whether of the crores of the ordinary citizens, who recive plenty of unsolicited sms, or that of the handful of telemarketing companies?

Advocate. Arunagiri (Expert) 07 October 2011
The TRAI had limited only the free SMS. You can send any number of SMS by paying cost there after.
gowtham (Querist) 20 November 2011
now they had increased the limit of the messages , its now 200 messages a day
