Sir, i want to ask you that can court would take any desicion on the basis that actual domestic violence had been taken place or not?Submission of made by her weather it is true or false?
or
Court will take any desicion without proper investigication?

The court will afford hearing to either side and after the due enquiary only pass orders.

In DV act, there are few reliefs which are accorded to women:

1. Maintenance
2. Right of Residence
3. Compensation (for Violence)
4. Compensation (for Loss of earnings)
5. Compensation (for other things like medical/ Streedhan/ Other Article etc etc)

Now, when it comes to maintenance, the only thing court would find out, whether she has a source of income or not.

For Compensation for violence, it is a matter of fact. Which needs to be proved by way of evidence.
