The State Government is competent to award compensation and its actions are well within its legal rights.

BUT DOESNT SUCH AWARD OF COMPENSATION FROM STATE'S FUND FOR MISTAKE OF PRIVATE PARTY A PAINFUL JOKE WITH THE HONEST TAXPAYER.
STATE SHOULD RECOVER FROM THE RESPONSIBLE PARTY.THIS SHOULD SET THE BALL ROLLING AMONG THE POTENTIAL WRONG DOERS.

That is your view.
My answer is confined only to your query - whether the award is legal - and I have answered. Rest is debatable it does not fall within the realm of law.

IS THERE A POSSIBILITY OF A PIL BEING ACCEPTED / ADMITTED ? THIS IS ALL I WANT TO KNOW.
i have posted this query under two different categories expecting to get reply from specialized experts in those laws. constitutional and civil.
R.Ramachandran (Expert) 05 October 2011
It is a million dollar question. I can say there is every possibility of a PIL being accepted. I can also with equal force say that there is every possibility of a PIL NOT BEING accepted.
