However for purposes of suit if no document is involved in which it is already valued,then according to court fees Act,it would be the market value of the property upon which the court fees would be required to be paid and for illustration any sale made near the property by a registered deed near the date of suit may be suggestive of such a valuation,in case it is not available then JANTRI value may be used as suggestive of valuation.How ever it further
made clear that a plaintiff is free to value his suit as per his valuation,the court does not sou motto looks it to be under valued but defendant after appearance can challenge it.
