Noc or sales deed for grand parents

Querist : Anonymous (Querist) 12 January 2012 This query is : Resolved
Dear all,
We have a land in my father's name (he expired few yrs back) and as per the legal heir certificate my grand parents also can claim this property.
Since my grand father is nearing his 90's i couldn take him to the registrar. So the sales deed was completed after my mom and sis signed it.. When i tried to get a loan from bank... The legal officer wants the sales deed with my grand father's sign too...
My question is will a NOC from notary help this case..?
The register ofc is flooded with many pending registrations cos of some revision in land pricing...
Any new application would take minimum 45 days.

So am left with no option....
I have started the construction months back... and am out of fund ;my loan is also pending cos of this...

Please let me know how to proceed in this situation....

Granting of loan depends upon the Credit Policy of the particular Bank on the basis of Credit rating of the borrower.

While sanctioning of loan to satisfy the titile of the borrower over the mortgaged property the bank can claim any document it wishes to see or have with it.
You can not help.
Notarial certificate would not help you.

It shall be better to get the duly sworn affidavit of your grand father with the banker and a NOC specifically for this purpose can also be got prepared and your grand father can also be produced before the officials of the concerned bank so as to verify the fact.

Teh experts have shown you different actions which can be taken.

But, at last, it is the bank who can decide what document to accept and what not.
