Digital photographs and videos

i have filed a suit againt my tenant for sublet the premsis he runs a restaurnat.. & has infringed licenses condition with regards to chimney.... he also creates a lot of nusiance and smoke..

the court has asked to me produce evidences

1) i have taken photographs & videos of the restaurnat with my mobile camera. but my lawyer is not ready to put them as evidenses .. he argues there will be technical questions asked so better to not produe photogrhs and videos.

he argues technical questions like who operated the computer & which stroes did u take the print...please suggest are such question valid in the small court.?.&
what are the questin that can come up for videos that we give as evidences.?

should i give the photograhs & vidios evidences or not... as i do not have any other evidence?

The video or photograph can be valid peice of evidence but before that it needs to be authenticated by a Govt, expert agency like Forensic Science Laboratory.
So do submit those articles and ask for appointment for expert for testing its genuineness.

also i have the stroage device & the bill of the stores where i took the digital print...! isnt that enough...?

if he has sublet the premises you can gather other evidence too .

sub tenant must be receivng letters in that address . showing it as his office address .

visiting card .landline telephone connection .

electricity bill if any .

best hire a detective agency they will gather sufficent evidence for you

Your storage device supported with bill of stores is sufficient to exhibit the video and photographs.

Your lawyer should read the latest change in law about digital cameras, photographs taken by such cameras and its frequent use in court proceedings.

@ mr ajay i have recived leeter in the name of the sublet ... but my lawyer says it might raise custody issue....( as how did i get those letter) so he is not putting those letter also.

and also i have acuired a copy of the registered firm with the registrar in the name of the sublet ( with my propert address)...but it does not ahve the proper address(i.e. shop no..)..we have given that to the court.

@ mr raj kumar.. plase inform me that which book can i refer for latest law on cameras.& digital print. photographs..if poosible with specific detail.( like the page no or the section)

According to Information Technology Act, & according to Indian Evidence act, the electronoic documents is also acceptable in as an Evidence.

yes ...but one point is not cleard ..
i.e if i submit letter of the sublet that i have recieved on my property address.... does an issue of CUSTODY OF LETTER arises...!!

as the sublet had shown his office in my property!!1
