Dear Sir
My wife had left me for the last approx 2 years in return of which I filed petition for Section 9 in reply of which she filed false complaint against me in women cell i.e. after approx 9 months of filing my RCR under section 9 ....Our mediation also got failed in women cell as a result I filed anticipatory bail on the basis of the complaint copy to the session court for apprehending arrest. The session court grant me 5 days notice to be issued to me prior to my arrest for applying regular bail. Now Sir the fake FIR has been registerd against me and my parents under Sec.498A,406 & 34 on dt.14.03.12. I want to know that its been almost three months of getting registered FIR against me so whether should i apply for the regular bail now on the basis of FIR copy or wait for the notice of arrest to be issued to me for applying of anticipatory bail?????????

It need not to wait for prior notice to your bail. You should move your AB to the court on apprehension of arrest together with section 9 petition and the order of the court in respect of meditation.

Which place the case is registered. If it is in Delhi, wait for the notice to be served upon you by the police before you move AB application.

Dear Rajiv and Shonee Ji Both of your replies are diffrent to each other .....Pls suggest me what should i do further....my FIR has been registered in Delhi and I have already been granted by the session court 5 days notice prior to my arrest from the police for applying AB. Now what should i do should i wait for the notice or apply AB on the basis of FIR........?????????
