Bank charge over property

Sir, Can we create banks mortgage charge over a property where charge for Bail of R.50K is created. Bank loan is more than 5 lac and propoerty cost is more than 10 Lac. Its an agri land

As the property is already charged as condition for BAIL it is for the bank to consider it or not for for accepting second charge. But it is advisable for obtaining written consent of the court which granted the bail.
