Dear learned brothers, pls clarify this issue wherein my my client has entered agreement of sale (unregistered) with builder for purchasing of flat and till date has paid 80% by availing bank loan now my client has personal problem so he not interested to continue the deal so builder is ready to cooperate and enter the deal with third party and one person is ready to purchase it since sale deed is not happened with my client because it is expensive so in this scenario how my client can come of the deal, which document he has to execute and get his money and pass clear title to new purchaser, tks.

obtain letter from builder that he is willing to transfer flat in name of purchaser .
your client has to sell the flat to third party by an agreement .the agreement should mention details of agreement entered into by the seller with builder and condiseration paid to builder . have the agreement duly sytamped and regd .
