There is some condition in Lease agreement property which as below.( Property of Agriculture Marketing Produce Committee - Gujarat )
(1) The Lessee have no right to sell of property , no right give on rent , no right to give on sub rent also and also have no right to participate in property.
(2) The lessee have mandatory duty to take all type of insurance on this property
(3) When the lease agreement complete at that time lessor have all right to decide the new value of property and who will give more value of this property in new lease condition lessor give property to them.
(4) if old lessee have no interest to agree in new lease agreement then he has no right on this property and also he has no right to take any type of property's market value or any discount from this property from lessor.
(5) The lessee have no right to transfer of property of any way.Also no right to transfer third party also. If lessee are interest to transfer of this property then first he must take consent of lessor for this property and after approval of lessor lease agreement transfer to another name which name suggested by present lessee.
(6)When present lessee or new party pay such fee for transfer then new party name appear in lease agreement.
(7) The lessee have must duty to pay all type of government taxes.
Now My Question is that ?
As per Indian government and gujarat government property law...
(1) When lessee want to transfer this lease property to third party...
Then lessee have right to create a new sub lease or deed of assignment under property law.
(2) Agriculture Marketing Produce Committee have right to give this type of permission to at present lessee for New Sub Lease or deed of assignment by way of law ?
