Builder's delay in completion of flat/ building

Dear Learned Experts,

I had booked a flat in 2009 and as per terms of agreement I was supposed to get possesion of it after 2 years from the date of registration.

Now it has been more than 3.5 years from the date of registration and the builder has not been able to complete the consturction in full. He offered few of the flat owners to give possession but in incomplete construction phase.

Can I file a case against the builder (in the agreement it is mentioned that if delays happens from builderes side, he is liable to pay the damages).

I would appreciate answer from you as well as if there is anyone from Pune on the board, I would like to take his help to file the case.

You are liable for damages for the extra time taken to complete construction.
Consumer forum is the place where you can explore your remedy.

Yes file a case in consumer forum against builder for damages of delay construction as per as agreement clause.

send a legal notice to the builder demanding damages as per agreement. File a case in Consumer Disputes Redressal Forum.

Non completion of construction work in specified period and non delivery of possession of flates in time amounts deficiency of services of builder also amounts unfair trade practice of builder.File complaint before District Consumer Redressal forum and claim compensation towards mental and physical agony.
