This query is : Resolved
My daughter purchased a patch of agri land in Bikaner some years ago and the same was duly registered in her name.We have record proof that the payment cheques issued for puchase in their name are debited from our account. However due to connivance of seller and Patwari, the entry of land in her name was not done nor allowed take over. Moreover, seller lodged a case on the contrary stating -
1.That they are legal owner as per record.
2.That she is claiming the land on false ground and is a "land mafia" trying to grab land of poor people..and have threatened to do so which we never did..my query-
1.If the entry of land is not done, can the purchase deed and registry be ineffective ?
2.Can we not file case of fraud when it was mentioned in registry that full payment has been recd.and that all rights are passed on and will have no claim on this land whatsoever in future..
3 That can we not file a strong defamatory case as they have blamed her as 'land mafia' etc in recorded statement under oath as I, a retired Suptg Engineer from govt. service and my daughter are respected citizen.
Please help advice..thanks.

pl. approach a civil lawyer, being a property matter.land being state subject and property also being located in rajastan, a case may be filed in civil court of competent jurisdiction depending on exact location near bikaner.
the case subjects shall be
1.)false claim of property ownership by seller and patwari by a dangerous liaison with private land seller
2.)use of words "land mafia",grab poor people land
3.)not updating revenue records by patwari which is his duty- wilful failure of duty leading to fradulent claims
4.)you have a strong defamatory case ground, as you have sufficient records of purchase deed ,payment of regn.fees, official receipt for same,EC.etc..
pl.have cert.copies of registry and pur.deed,regn.fees receipt,etc... ready and meet up a civil lawyer and act fast

If you have records for funds transfer and registration of sale deed in your favor, you can proceed legally against the erring vendor or the patwari who refuses to transfer the records in your name, further if it is proved that they used defamatory words namely land mafia, you may proceed with libel case too.
