Limitation for criminal case as defined in chapter 36 section 468 crpc

(Querist) 27 March 2014 This query is : Resolved
Dear Sirs,

Limitation as per section 468 A, B, C read with section 472 etc.

We understand the limitation for taking cognizance under 468 Crpc

468(A)6 Months if offence is punishable with fine only
468(b) one year if offence is punishable with imprisonment for a term not exceeding one year
468(c) three year if offence is punishable with imprisonment for a term exceeding one year but not exceeding 3 years

But, is there any limitation for taking cognizance ffence is punishable with imprisonment for a term exceeding three year ???.

Like 468 IPC - s punishable with imprisonment of 7 years

What would be the limitation of taking cognizance if complain was given to the police 6 months back under 463IPC+468 IPC However, Police has not taken cognizance till date.

Also advise the effect in view of the latest judgment rendered by Hon'Ble Supreme Court in Latika Kumari Vs Govt of U.O. in CRL M.O. NO. 5029 of 2014 ( WP CRL No 68 of 2008)

Please suggest with your expert view
