How to secure the property deal after paying 20% amount of agreement value

Dear Sirs,

Pls find the below case study of my query.
I have finalised one flat in dombivali, Kalyan Maharashtra. Now the possesion of the flat is after 3months. Now as per the law of developer seller cannot sell the said flat till possession. registartion of the said flat can be done only after possesion and NOC from developer as society is not formed.

Now seller wants to sell the flat as he is in need of money and i want to purchase the property.

We have agreed that i will pay seller 20% amount of the agreement value. Now i have a query how can i secure myself legally so that the seller cannot sell the flat to anyone else and my initial 20% are also secure.

I thought of making MOU which will be notarized..
Or If i make the agreement to sale, i have to pay entire stamp duty and registration which is not possible without NOC of developer.

Pls suggest which agreement i can make and pls send the format if possible?

first obtain NOC from developer then proceed . we dont provide formats . consult a local lawyer

for drafting the agreement consult a local lawyer. formats are not provided in this section.

Better get all formalities completed including obtaining of NOC before deciding about the purchase.

where he claims that he is practising from 2001, while as already indicated by me, he was enrolled only in the year 2012!!! CAN ANYBODY PRACTICE BEFORE ENROLMENT? IF ONE DOES SUCH A PRACTICE IS HE NOT FIT TO BE CALLED A "FRAUD"?
