Fraud by builder

I have booked one 300 sq yds plot in yakut pur village in Noida through Sai Builders having office in Faridabaad Haryaana.after paying 70% of amount We have found that the Builders has closed his office and now absconding later on we came to know that he has cheated some 300 peoples.

Kindly advise us about where to appeal for case as local police is not taking any steps they have refused to lodge an FIR also.
Can we move to consumer court or we have to approch civil court.
We want either our money to be refunded orplot.

Dear Querist
File a complaint u/s 156(3) of Cr.P.C against the builder before magistrate at Noida or Faridabad, as you think fit. The police is bound to registered an FIR on the information of any Cognizable offence.
You may also file a complaint before Consumer court and claim your money with the compensation.

move consumer forum against the builder for necessary reliefs . also file complaint under section 156(3) to direct cops to investigate

I to agree with the experts advise that the author should file a private complaint u/s 156(3) cr.p.c. before a judicial magistrate court and to file a consumer case too simultaneously.
