Diciplinary action

In Diciplinary action fine imposed of rs 50000 employee challanges the order to Industrial court, Hon'ble court granted status quo .The employee will retires on 31/10/2014 can department retain the Punishment amount till disposal of case ,whether there will any contempt?Please reply immidiately

1. If the Industrial Court has granted status quo that amounts to that the employee will not pay the punishment amount and the premises of the disciplinary action coming to conclusion of penalizing such huge amount would be inquired in due course of time.

2. After the retirement such punishment put under status quo cannot be made to realize from the employee through any means of fore fitting his other retirement benefits.

Department may take undertaking / surety that in case the case is decided in favor of department the employee would pay the amount.
