Real Estate Cheating

I was cheated by a real estate builder who belongs to SC community. And also he is threatening to file a false case under"SC/ST Atrocity Act". I want to file a case in Consumer Court to get back my amount. Is it a right choice? What should I do to guard myself from the false case mentioned above. Need your help pl.

Dear Mr.M.Vishwanath,
You have not stated the facts of your case otherwise you are very much within your right to seek refund. If the builder is threatening you you take a peremptive approach and put on record his threat on paper.

Dear Mr. Daksh,
Thank you very much for your encouraging words. I have paid an advance of Rs. 4 lakhs for construction of an independent house in a group of complex. Even after 1 year, he did not start construction. Now I came to know that there is dispute between the builder and the landlord. And also the builder is not even having the rights on the plot we have selected. We have got only receipts for the amount paid to the company and no other agreement papers (no agreement reached). Now can you pl update me for which I will thankful to you.

Lodge a criminal complaint against the builder since he has deliberately cheated you without an agreement from the land-owners. If he chooses to file the counter complaint, fight it out vigorously. Certain people misuse this SC/SC atrocity act just like 498A cases since it is non-bailable. Unfortunately, this happens only in Tamil Nadu!
